Not new news but I thought we should have a thread here rather than just in the tabloid section.

MICHAEL JACKSON ESTATE FILED COMPLAINT AGAINST HOWARD MANN AND NINE OTHERS
A complaint for infringing the copyright was filed by Michael Jackson Estate against ten individuals and organizations
                                                                
John Branca and John Macclain are the executors of Estate of Michael Jackson, Michael Jackson Company and Optimum Productions. They have filed a complaint for copyright infringement and other counts on Howard Mann, Sonia Lowe, NetCast Media Group, Vintage Pop Media Group, Vintage Pop Media and Vintage Pop Inc. in the US District Court at the Central Division of Central District of California.

Zia F. Modabber and Howard Weitzman, the attorneys filed the complaint on the behalf of the plaintiff and have put forth before the court the illegal use of the intellectual properties of Michael Jackson by the defendants in several ways. Modabber and Weitzman have asked the court to take action against the defendants for their illegal use of the intellectual properties of Michael Jackson such as photographs, copyrighted artwork, sound recordings and printed song lyrics through their websites and other means.

The Michael Jackson Company is a Delaware based LLC, MJJ Productions is California based Corporation and Optimum Productions is a California based Corporation and in the complaint these are posed as Plaintiff. All these organizations are legally engaged in utilizing the intellectual properties of Michael Jackson, their advertisements, marketing and publication. These are also responsible for the protection and preserving all these assets.

The attorneys from the plaintiff side have alleged in the complaint that defendants collectively or individually are engaged in infringing the copyright by using the name of Michael Jackson and his intellectual properties to make illegal money. Total of 12 number of claims are put forth the court through the complaint including copyright infringement, Cyber squatting, Cyber Piracy, False endorsement, misappropriation and unfair competition.

Modabber and Weitzman have asked the court to order for stopping the so called illegal activities by the defendants while compensating the plaintiff Estate of Michael Jackson as per the law.

There is a hearing today at 10am on Howard Mann and Vintage Pop motion to dismiss this lawsuit, this link show some very interesting information on Katherine and the Jackson Clan.

The figures they mention in the above document seem weird to me, Katherine has only recieved $160,000 and the trustees have taken $80 million?

Michael Jackson's mom claims he did not trust his estate executor

Michael Jackson's mother is lashing out at one of the executors of his estate. Katherine Jackson claims in a court document that her son never even liked John Braca, adding that the King of Pop was worried he stole from him.


Katherine filed a declaration in a case involving Michael's old charity, the Heal the World foundation. The documents state that the Jackson matriarch is furious that the estate is going after the organization for using her son's image and likeness without permission.

She said in the papers obtained by TMZ, "Michael would be very upset if he knew that our charity was being torn down by people who say they are doing what he wanted."

She stated that Michael did not like Branca when he was alive, saying, "Mr. Branca was a man that my son was very worried about."

"Michael told me on more than one occasion that he did not like this man and did not trust him, he told me that John had stolen from him."

And as if to reiterate her point, Katherine said, "This lawsuit is exactly the type of awful thing that Michael said he was capable of doing."

Katherine also wants the estate to support Heal the World financially.

A representative of Michael Jackson's estate fired back, saying Katherine's declaration "contains many lies" and are just a "pathetic attempt to hurt the man who single-handedly… resurrected Michael's image and fortune."

The estate's lawyer, Howard Weitzman, told TMZ, "I would like to think that someone else prepared this for her and she just signed what she was asked to."

"The Jackson family has NO rights to determine what charities receive money from Michael's estate but Mrs. Jackson will certainly have input."

"The executors have also seen to it that Mrs. Jackson, as Michael wished, continues to live in the style Michael provided for her by paying off the mortgage on Hayvenhurst; renting a palatial home for Mrs. Jackson and the children to live in while Hayvenhurst is being renovated; and paying for all of her and the children's needs."

Michael Jackson Estate Can Proceed with Lawsuit Against Memorabilia Website

A federal judge is allowing a lawsuit brought by the Michael Jackson estate to continue against the operator of a website that sells various MJ memorabilia.

The lawsuit was filed last year against Howard Mann, who operates MichaelJacksonSecretVault.com, which sells rare artwork, photographs, sound recordings and other merchandise. Notably, Mann is a former business partner of Michael Jackson's mother, Katherine, and the lawsuit represented an aggressive attempt to police the late singer's intellectual property and likeness after his passing.

In an order denying a motion to dismiss, Judge Dean Pregerson is allowing the lawsuit over whether Mann is trying to cash in on Jackson's legacy to continue.

Mann attempted to dismiss the case based on a 2004 lawsuit that was dismissed at a preliminary stage, but the judge rules that the record in that case was "undeveloped" and the identity of the claims are subject to factual dispute.

In another legal development involving the Michael Jackson estate, it has reached a settlement with a nonprofit that claimed to be continuing the singer's Heal the World charitable work. The estate claimed this is infringing its trademarks and the pop singer's likeness rights. Terms of the settlement are confidential.

The Michael Jackson Estate vs. Howard Mann
Howard Mann's lawyers filed their list of witnesses, what is... the strangest set of people ever seen! Just to name a few:
Dr. Tohme,
Katherine and Joseph Jackson,
All the Jackson siblings,
Henry Vaccaro,
Joel Katz,
Al Malnic,
Didier Witzner (might be Dieter Wiesner :) ),
Brian Oxman,
Adam Streisand,
Longdell MacMillan (aka. Londell McMillan :) ),
Randy Phillips.

They are citing multiple letters between parties like Brett Livingstone-Strong, Henry Lowell and Katherine.

On the other side the MJ Estate named his witnesses as well, where similar names appears, with the addition of Trent Jackson and Melissa Johnson.

The case might go to trial with the estimated start of June 11, 2012.

As an interesting twist in the story, Henry Vaccaro's private investigator who found the Jackson memorablia back in 2002 filed a petition in the case. He claims that he is entitled to 14% of anything that comes from the collection. And he doesn't care who pays him, Vaccaro, Howard Mann or the MJ Estate.

Mann and Vaccaro jointly filed an opposition that the investigator doesn't have any interest in the memorablia. However they didn't provide any details.

On the other side the MJ Estate filed papers from the 1996 case where the Judge decided to sell the Jackson family estates, except MJ's and Janet's. Now they say that Vaccaro have not been entitled to get any of MJ's properties, neither he could have sell it.
This means that the MJ Estate changed it's strategy, and now they are going after the previous court decesions, and they want to get all the MJ related items, not only stop Mann and Vaccaro.

LOS ANGELES (CN) - An investigator claims the former owner of the world's largest collection of Michael Jackson memorabilia owes him $25,000 for his work finding assets to seize from Jackson's family.

Frank Coonis sued Henry Vaccaro St. and Jr., eight corporations and LLCs and four other people in Superior Court.

Coonis says "defendant Vaccaro" hired him in 1998 to find assets from the Jackson to satisfy a judgment that Vaccaro's company held against certain members of the family.

The Vaccaros became the owner of the world's private largest collection of Jackson memorabilia after years of legal battles with the family, who bought Vaccaro's guitar company in 1992, according to the New Jersey Star-Ledger.

Coonis says Vaccaro won judgment against Jackson, but the Jackson family said they had no assets, so he was hired to find them, which he did at a cost of $180,000 and hundreds of hours of work.

He says Vaccaro promised him 14 percent of the assets he recovered, including money and property. He says he has made "repeated demands on defendants" for his 14 percent commission, "but defendants have paid no monies to plaintiffs."

He seeks an accounting, an injunction, and damages for fraud and breach of contract.
Coonis and Frank Coonis Investigations are represented by Donald Ricketts.
Defendants include the Vaccaros, HHV Corp., and Vintage Pop Inc., all of New Jersey.

LOS ANGELES — A federal judge has ruled that a website and businessman working with Michael Jackson's mother has violated some of the singer's copyrights and should be blocked from future uses of the works.

The estate sued Mann in January 2011, claiming he was violating copyrights and posed unfair competition to Jackson's estate. Pregerson ruled that the website improperly used art from the film "This Is It," a logo featuring Jackson and the song "Destiny," as well as other material.

A phone message for Mann's attorney was not immediately returned Friday. Mann has collaborated with Katherine Jackson, who is a beneficiary of the singer's estate.

The ruling does not address damages.

The Michael Jackson estate has won a major victory in court. The executors have triumphed over Howard Mann, the Canadian business man who published a book of photos with Katherine Jackson without the estate’s permission. Mann also purchased a boatload of souvenirs and Jackson family memorabilia from a warehouse owner in New Jersey. Among the items were tapes of music by Michael Jackson. Mann claimed ownership of the copyrights of those tapes even released a song from the collection. Now, with a summary judgment, the court has ruled against Mann. He’ll have to shut down his Jackson websites, especially the one selling the book of photos. Mann took a bath on that book, too. He has cartons and cartons of them somewhere. More to come…
