SONY Hacked, Michael Jackson Songs Stolen
« on: March 04, 2012, 04:38:51 PM »

Michael Jackson's entire back catalogue and a wealth of unreleased material worth €190 million has been stolen from Sony music by hackers in a second major security breach at the company within a year.

The hackers allegedly downloaded more than 50,000 digital music files in the biggest ever cyber attack on a record company.

Sony paid the Jackson estate $250 million dollars for a seven year deal in March 2010, nine months after the singers death aged 50.

The contract allowed for 10 new new albums including unreleased material from the studio sessions that produced the classics Off The Wall, Thriller and Bad.

Some of the previously unheard material includes duets with artists ranging from the late Freddie Murcury of Queen to the Black Eyed Peas singer Will.i.am.

"Everything Sony purchased from the Michael Jackson estate was compromised", said a well placed source.

Hackers attacked Sony's Playstation Network in April and stole the personal data of 77m users, including some credit card details. Sony's share price fell and the security scandal cost it €127m and huge damage to its reputation.

The Jackson hack was discovered weeks after the Playstation hack but has not been revealed until now. It was discovered only from routine monitoring of social networking sites, Jackson fansites and hacking forums.

"It caused them to check their systems and they found the breach. There was a degree of sophistication", the source added. "Sony identified the weakness and plugged the gap."

The theft has implications for all living and dead Sony Music artist. The company distributes the Jimi Hendrix back catalogue, and its roster of artists includes Paul Simon and Leonard Cohen as well as newer acts such as Olly Murs, Chris Brown, Foo Fighters and Avril Lavigne.

The hack coming so soon after the previous cyber attack "would have made investors and artists think, "What other part of Sony isn't secure" said the source.

Sony Music confirmed last night that it had been hacked and its Michael Jackson material stolen. The company refused to say how much was downloaded.

A Sony source said the company immediately alerted the Michael Jackson estate after the hack but had no obligation to make the theft public as it had not involved customer data.

The hackers allegedly left "fingerprints" on the server that allowed experts to identify IP addresses in the UK, the Sony source added.

The company then contacted the cybercrime wing of the Serious Organised Crime Agency, who took over the case.

Two men appeared in court this week charged with offences under the Computer Misuse Act.

They denied the charges and were remanded on bail.

50000 digital music  files, I find that a lot. I don't understand why they put all his back catalogue like this on line without security.In fact we all know that there is  no security on line....

I dont know either,  :pullhair: but would explain how sooo many songs have leaked. Of course they have denied the charges, cos illegal downloading is seen by soo many now as normal and not a crime. I have no sympathies for them & if I was in the UK I would go to the court and be in the public seats and report back to the fan community just who these scum are!!

@SuzanneMarks1
The press reported about my Husband is false! Its a case of them making up the parts they dont have yet, this is a stitch up from day one!

@SuzanneMarks1
MJJC & their staff need to get their story straight b4 posting bout my husbands case, MJJC have been lieing for months the truth is coming

@Ivy_MJJC
@SuzanneMarks1 it's not "our" story but what we have been told. We believe to be misled about the source of them

@SuzanneMarks1
@Ivy_MJJC MJJC is caught in this situation because Gaz leaked cascio snippets & James's mix on Ustream

@Ivy_MJJC
@SuzanneMarks1 What we have been told by James versus what we have been told by law enforcement has been two different things.

@SuzanneMarks1
@Ivy_MJJC Also Gaz was well aware of the situation and asked James and Cartman to find more rarities for MJJC Exclusives!

@SuzanneMarks1
@Ivy_MJJC Of course it was, like they changed the charges 30 minutes before hearing because they had no hope of prosecuting him.

@Ivy_MJJC
@SuzanneMarks1 and also what I meant by caught in the middle was totally different than what u r talking abt. ps: What are the charges?

@SuzanneMarks1
@Ivy_MJJC Also I dont see the relevance of this, Gaz was beggning them for the cascio tracks and other demos to leak on MJJC

@SuzanneMarks1
Wait until court, see the evidence, we have both screenshots and logs of Gaz's begging for unreleased music, dont let them lie anymore

On twitter, Birchey said that they detected his IP requested 49 000 downloads. Is it related to the 50 000 files mentioned in the article?

Posted by Pentum
Exactly. They never downloaded all of these files, they only got the Cascio songs. That's it. No 50K files. No idea why THEY SAID his IP had 49k requests.

reply by qbee
BS - You were here and know for a fact mixes and videos were made from NON- Casico songs that they stole. Before we knew what happened the Fans were saying OMG where did you get that .... So how can you say that in all honesty.

His IP may have had 49 requests - but maybe he wasnt able to acess them all. We dont know the whole truth of the matter from the media. Some of us are aware of what went down more than others But if they did declair 49 requests were on his IP ... They certainly will have info from his Internet provider to prove that.

Posted by Pentum
Qbee, don't talk without knowing the real story or at least more of it. I'll tell you again, the only stuff they got from the server was the 12 songs. What else are you talking about? Elaborate.

The other guy was a member on here called cartman.

The reporting on this case is wildly inaccurate. As someone who knows a fair deal about this, I can state that the bulk of what was taken, following a hacking that was committed by other individuals who have not been charged, was the material submitted by Eddie Cascio. None of the material was ever sold for profit and neither defendant ever leaked any of it online. It was done as an attempt to expose the alleged fraud behind the Cascio tracks, and the info obtained was extremely helpful and has been heavily discussed on this forum and others. This issue (Cascio tracks) will be discussed in court and forms a large part of the defence. I will be following the trial in person as it takes place in my town. However, it doesn't start until next January.

posted by IVY
Honestly I don't see how these admissions of "they entered the server" but "they did it to expose the songs fraud" are helping Birchey and Cartman. To me it seems like these admissions do prove Sony's complaints that songs were taken in an unauthorized fashion with the intention to hurt Sony.

posted by Ivy
Well as MJJC and their staff has caught in the middle of this situation due to Birchey and Cartman being members here, we are kinda privy to what Sony says as well. So our "story" isn't limited to Birchey's version - and it's not "our" story , it's what we have been told. We know that Birchey (and his wife) doesn't agree with the claims against them so it's not surprising to see her to call it "lies".

posted by qbee
it was Birchey himself that stated he was supplied a link to the Sony server and went in and
downloaded - So if anyone is lying they are just repeating his own words. I dont see anyone,staff
or members here stating Birchey personally hacked into Sony account. We dont know.

Now I may have been mistaken in posting that I thought he took more then just casico songs but that
is my personal opinion and possible error .

MJJC STATEMENT REGARDING THE SONY HACKING

Dear Members

Birchey did share snippets and mixes for us to play on our ustream show as they were greatly done and like many other professional fan mad mixes ones in which the fans loved to listen to.

However we had no prior knowledge of how they were obtained what was in them or that they were indeed stolen in the manner that they were.

MJJCommunity was served a warrant to surrender its server to SOCA due to the case they had against Birchey for accessing its server and stealing its content.

We had no choice but to adhere,

It was then that we were made aware where these mixes these snippets had come from, thus a blanket ban of all such across MJJC.

Be aware many dj's many fans send me/us fan made mixes of Michael Jackson songs many of which are freely available on Youtube.

I was and am still very angry with those who stole these songs based on what could have happened to our beloved community at one point I was going to publicly out those who stole and shared with the innocent without telling them where these items had come from, never was our beef with the Estate or Sony, I in one of my tweets used the term "seriously dertail" this term should have been "seriously detail" we/I was very upset based on the happenings and was only every angry at those who stole putting an entire community in jeopardy for personal greed.

From this day forward we work closely with the legal team of Sony to ensure we comply with all copyright policies, this is not a partnership nor a working relationship but one to ensure our community is safe and complies on all accounts.

We are innocent and there is no case directed at MJJC due to our due diligence in this matter our handling of our operations relating to copyright and our consistent efforts to assist those who are the owners of said material.

Regards

I know, this has far wider implications, the fact that fans and a fansite involved, that people can turn a blind eye to the crime being committed all so that they can have rare and exclusive songs, that they can get their Michael fix no matter the consequences, that fans have so little respect for Michael's life work that they can just go and take whatever they like and use it how ever they like.

MJJSTREET from the very start has always had a zero tolerance policy about posting links to leaked songs. In fact I have not listened to, never mind downloaded ANY of the songs which have leaked since June 09. I have always felt that song leaks are wrong, so much so that I refused to even listen to ESCAPE when it leaked, refusing to have anything to do with it cos Michael was so upset and angry. Knowing how much it hurt him to have his work stolen, I just can not justify or condone illegal leaks

Michael Jackson back catalogue allegedly stolen by hackers
Beatrice Woolf
guardian.co.uk, Monday 5 March 2012 00.52 GMT

Michael Jackson's back catalogue has allegedly been stolen from Sony Music by hackers, it has emerged.

More than 50,000 music files, most of which were by the late pop legend, are said to have been illegally downloaded.

Jackson's estate signed the biggest recording deal in history, worth $250m (£164m) with the company in 2010, giving it the rights to sell his whole back catalogue as well as previously unreleased tracks.

On Friday, two men who were arrested last May appeared in court in the UK accused of offences in connection with the alleged security breach.

James Marks, 26, from Daventry in Northamptonshire, and James McCormick, 25, from Blackpool, denied charges under the Computer Misuse Act and the Copyright, Designs and Patents Act at Leicester crown court. They were released on bail, the Serious Organised Crime Agency said. They are due to stand trial next January.

The incident comes less than a year after the names, addresses and other personal data of about 77 million people with accounts on Sony's PlayStation Network (PSN) were stolen.

The company warned it had been hacked last April when an "illegal and unauthorised person" got access to the information, forcing Sony to temporarily shut down the PSN, which allows owners of the consoles to play online games and rent films.

Private investigators were called in and Sony issued an apology for the "frustrating" security breach, promising it was taking steps to make its services "safer and more secure than ever before" in the wake of the attack.

Sony Music is home to a string of major artists, including Leonard Cohen, Paul Simon, Foo Fighters and Avril Lavigne, and also distributes the music of Jimi Hendrix.

Its catalogue features what it calls "some of the most important recordings in history".

The company signed its contract with Jackson's estate nine months after he died from a drug overdose at the age of 50, leaving hundreds of millions of dollars of debt behind him.

The deal also entitled the firm to use his music in computer games, television adverts and elsewhere, with profits from the arrangement to go into a trust shared by the singer's mother and three children.

Sony Music declined to comment on the latest alleged hacking incident.

Soca's involvement in the case comes after it shut down popular music site RnBXclusive last month, warning users that the majority of music files available via the website were stolen from the artists.

posted by IVY on MJJC

A little background: Sometime in March last year, Birchey warned us that someone got HT remixes from a promotional link that Sony sent to Dj’s and told us to watch out and not allow links to it as posting links to official material is against MJJC policy.

In early April, Birchey on our forums had written that he had all 12 Cascio songs. Obviously everyone was curious about it. When we were discussing it, he said that the songs were obtained by similar fashion to the HT remixes. He said the songs were easily and openly accessible through a promotional link Sony sends out to DJ’s and that someone gave the link to him. Birchey told us that he notified Sony of the breach and helping them to stop it. Also he said that he’ll never leak the songs and will stop anyone from doing so as well.

As you can see at that time we had no reason to think that this was intentional, or it was a theft, or it was anti-Sony or anti-Cascio. As far as we know, it was quite the contrary; we believed Birchey to stumble upon these semi-public songs and he was doing his best to the point of working with Sony to stop the breach in the servers and future leaks. That’s what we believed to be true at that time and therefore did not see a problem. All of our interactions and actions were based on this belief we had at that time.

Sometime later small snippets started to get posted around the Internet – not by Birchey – and sometimes they found their way to MJJC as well. At that time we received regular copyright claims from Sony asking us to remove the links as it’s their copyrighted material. This didn’t raise any alarms as at that time they were communicated to us as regular copyright claims and we occasionally get them for MJ and non-MJ material.

Then one day came the shocking news that Birchey was arrested for fraud. We couldn’t make sense of it as we thought he was helping Sony with the breach in their servers and we never thought he could be involved in any leaking as he was the one that warned us about any potential leaks to stop them. There was a lot of confusion going on and we didn’t understand what was happening. We were shocked and worried – both for Birchey and MJJC. Soon we learned from Birchey that Sony was claiming that he took and leaked the songs intentionally to reduce their future value. I have to add that Birchey denied these claims in our conversations.

Then came the law enforcement. We were notified that they wanted access to MJJC to investigate the claims against Birchey and later on they executed a court issued warrant and confiscated MJJC servers from MJJC's hosting provider. It was out of our control. That was the time MJJC was down for multiple days and when we didn’t know if we’ll get back the servers or not.

Sometime during that time we learned that Cartman was also arrested as a co-conspirator and we learned that Sony claims the songs weren’t that easily accessible as Birchey portrayed and it required a deliberate attempt and long search to find and get them – hence the hacking and stealing claims – and that they believed there was a motivation, an intent to get these songs (anti-cascio).

So that’s what we know. As I said before there’s not an “our story”, it’s just that there are two different versions to this event. What we have been told by Birchey and what we have been told by law enforcement has been two different things. It’s not our place to determine who is right or wrong. It’s a question for a court, judge and jury.

Despite the recent accusations against MJJC, I also want to say that as MJJC staff we don’t want to see anyone – especially a fellow MJ fan that we know and loved for a long time – to get hurt. As I said to Birchey multiple times, our hope is that this gets resolved in a friendly manner and Birchey & Cartman as well as other parties can walk away from this with no damages whatsoever.

@SuzanneMarks1
FACTS 4. No Access or downloading of any Previously unreleased, Unleaked or Unheard Michael Jackson song EVER happened....

@SuzanneMarks1
Infact those songs were taken and offered for sale to my husband and others, police are aware of these people but are not investigating!

Tink I know, me too, I dont have an ITUNES account, I only buy actual physical music. I have heard ESCAPE but have not heard even one of the post 2009 leaks, in fact I couldnt even tell you the names of the songs that have leaked. I dont even spend time on youtube looking for or listening to Michael music. I have completely stayed away from ALL Michael music since June 2009.

I agree, theres a whole generation now who see nothing wrong with downloading and sharing files, and its not just confined to songs, how many now think nothing of downloading for free the latest film releases from a file sharing site instead of going to the cinema or buying the dvd???

I have ALWAYS been against song leaks, I think I was one of the few fans who completely stayed away from all the INVINCIBLE song leaks way back in 2001. Back then the forums were full of snippets and fans spent hours discussing the lyrics etc but I refused to have anything to do with all that. The first time I heard the songs from Invincible was at the SONY UK / MJNI official launch party the day before the album went onsale
