I want this resolved once and for all in favor of the MJ estate
what to expect? there will be oral arguments and judge might ask questions. As this involves a confidential settlement I expect it to be in chambers or in closed court. Then the judge will make a decision. We'll see it when the decision is filed with the court - hopefully soon and hopefully not sealed.

I can't tell you what the outcome will be as the documents are sealed and I wasn't able to read either side's argument. So I have no idea who has the stronger case here.

why would the arguments be sealed ivy? every things normally out in the open for the public to read. what would be in these arguments that we dont already know? i presume it was sealed cause its details of the settlement which are private?
exactly. as they are arguing about the confidential settlement agreement and referring to it in their motions they asked the judge to seal the documents. Judge put a limited seal on the case - meaning just sealing the documents that refer to the settlement and the latest motions about it. The rest is still public.


it might take some time for the judge to come to a decision. even if the judge comes to a decision instantly it would require the court clerk to type and put it in the system. so it might be soon or it might take time. there are some people that attend court hearings but as the settlement is confidential they might or not learn anything about the outcome as well.

THREAD MOVED TO HERE, SO WE CAN DISCUSS IN PRIVATE

As things have got very complicated, I asked Ivy for a recap, this is what she sent me

They were supposed to go to trial in April 2011 but they settled on the first day of trial. The settlement is confidential although it's reported that Estate will take over HTWF and the trademarks Melissa registered and Melissa would get a seat on board of directors of HTWF. Later we learned Estate also would pay Melissa her expenses. Soon after HTWF rescinded the
settlement saying that Melissa had no power of signature to sign for HTWF (and it needed a board of directors approval). Estate moved for asking for enforcement of settlement. Most documents are sealed / confidential but end of June 2011, the judge enforced the settlement and terminated(closed) the case.

When Melissa rescinded the settlement and created all types of problems Melissa's lawyer Pease (who was found and paid by Mann) stopped being her lawyer. Melissa claimed Pease to be "bought" , Pease claimed Melissa was crazy. After having a temporary personal injury lawyer and missing the appeal deadline Melissa hired a decent lawyer.

This decent lawyer argued and convinced the judge to allow them to file an appeal late. He also argued some of the trademarks Melissa registered in her name (not in HTWF name) should be left out of the settlement. We have no idea about how the judge decided because it's sealed. We also learned that Estate did not pay Melissa her expenses because they thought the
numbers to be inflated.

Anyway the appeal was filed and soon after the lawyer asked to be relieved as counsel as he was not being paid. Melissa got another lawyer. Court tried to mediate the case but it failed. The opening brief was due June 1st but Melissa's lawyer filed a motion asking for a 90 day extension saying that the court reporter couldn't prepare the transcripts and he just got some information from Melissa and needed time to prepare his opening brief. Estate did not object to this request on the basis that it
was court reporter who wasn't able to do her job. So the court granted the 90 day extension. Current schedule is "The opening brief is due August 30, 2012. The answering brief is due October 31, 2012. The optional reply brief is due within 14 days after service of the answering brief."

This is where the case is and we'll wait. We'll get the briefs on or before those dates, there could be an optional oral hearing set and then we will wait for the decision of the appeals court.

If the appeal is denied, then the case will be over, the settlement will be enforced. If the appeal is granted, it will be sent to the lower court and a second trial will happen to determine the outcome.

your welcome. Things were getting way too complicated and I thought it was just best to ask for a recap, instead of trying to go through everything and figure it out.

It also makes sense now, why Taaj is asking for people to send money to help Melissa, it looks like she is running out of money  :rollseyes:

Although I have her on twitter, to be honest, I usually by-pass her tweets.

2 days before Opening brief is due HTWF's lawyer files a motion to withdraw due to non-payment of fees.HTWF is asking 60days to find counsel

as per court document above, Melissa Johnson's attorney has asked to be removed from the case as he has not been paid. Melissa has 21 days to find a new attorney. If she does not , the case will be dismissed and the previous ruling of settlement will be upheld.

So yet again, her attorney has not been paid and been removed from the case. Where is all the money going??? Taaj has been on a major donation drive for many months, saying the money is for Melissa's court expenses, yet now 2 attorneys have left the case for the same reason???

I saw many tweets about donations being sent to Taaj re HTWF and people saying where have the donations gone.

But I am confused, as per my previous post above, I have never seen any requests for donations.

Am I being completely blind or something?
Do I need to invest in some reading glasses?
